TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEOWNERS PREFERRED’S TOTAL LIABILITY ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- The amount you paid directly to Homeowners Preferred during the six months preceding the event giving rise to the claim; or
- One hundred United States dollars.
These limitations apply regardless of the legal theory asserted and even if Homeowners Preferred has been advised of the possibility of damages.
Some jurisdictions do not allow certain liability limitations. In those jurisdictions, the limitations apply only to the extent permitted by law.
16. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Homeowners Preferred and its owners, officers, employees, agents, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, expenses, and reasonable attorneys’ fees arising from or relating to:
- Your violation of these Terms;
- Your unlawful or improper use of the Website;
- Information or content you submit;
- Your infringement of another party’s rights; or
- A dispute between you and a service provider.
17. Suspension and Termination
